Governing Law

The use of this website and these Terms and Conditions are governed by the laws of New Zealand, and any disputes arising out of the same shall be resolved by the exclusive jurisdiction of the courts of New Zealand.

Declarations for Finance Application

By submitting a finance application through our website, you:

1. Declare that the information provided in your finance application is true and correct and that you are over the age of 18 years and are not an undischarged bankrupt.

2. Give permission to MMML to verify any information that you provide (or information that we may collect from other sources) with third parties and third-party databases, including Government agencies, for purposes related to your application for credit or administering your account with us, including for fraud prevention and complying with the Anti-Money Laundering and Countering Financing of Terrorism Act 2009.

3. Appoint MMML as your agent to collect, use, and disclose your personal information for carrying out credit checks with a credit reporting agency for the purpose of making a recommendation for a credit facility to an MMML Finance Partner. This includes providing your information to the credit reporting agency and receiving information about you from the credit reporting agency.

4. Authorise any third party to provide your personal information to MMML for any of these purposes during and after the process of applying for finance.

5. Understand that if MMML discloses your personal information to a credit reporting agency, they may hold your information on their credit reporting database and use it for providing credit reporting services and for any other lawful purpose. They may also disclose your information to their subscribers for the purpose of credit checking or debt collection or for any other lawful purpose.

6. Agree that the MMML Finance Partner may, in accordance with their privacy policy, collect personal, financial, and commercial information and references about you as is necessary for considering this application and may produce this authority to such parties for the purposes of collecting such information. A list of MMML's Finance Partners (including their addresses and links to their privacy policies) is set out in our Privacy Policy.

7. Agree that MMML may communicate with you via mail, email, telephone, SMS, or app for all purposes, including general communications and promotions. You consent to documents required by law being sent by mail or electronic format.

8. Agree to meet the cost of an independent valuation of the security to support this application, such valuation to be obtained by MMML in consequence of this application. Your solicitor/agent is authorised to accept any notification on your behalf.

9. Agree that MMML is authorised to disclose your personal and financial information to disclosed referral partners for the purpose of providing additional products and services.

10. Agree that MMML may share your email address and other contact details with marketing and analytics platforms, including but not limited to Google, for the purposes of remarketing, customer communications, service improvement, targeted advertising, and creating audiences to reach potential customers. You may opt out of marketing communications at any time by using the unsubscribe link in our emails, adjusting your preferences at adssettings.google.com, or by contacting us at privacy@matchmemoney.co.nz.

11. Acknowledge and consent to your personal information being disclosed to overseas recipients, including service providers and platforms located in Australia, the United States, and other jurisdictions where our partners and service providers operate. You expressly consent to such disclosures and acknowledge that your information may not receive the same protections as provided under New Zealand's Privacy Act 2020 when transferred to jurisdictions without equivalent privacy laws.

12. Acknowledge that where MMML collects your personal information from third-party sources (such as credit reporting agencies, referral partners, or publicly available sources), we will take reasonable steps to notify you of such collection, the purpose of collection, the source, and your rights, in accordance with Information Privacy Principle 3A of the Privacy Act 2020.

Acknowledgements about your Finance Partner

You also acknowledge that if the MMML Finance Partner provides this finance, they:

1. Will retain your personal information for the period required by law, including under the Credit Contracts and Consumer Finance Act 2003 and the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 (generally at least seven years after the end of the credit facility).

2. May provide MMML with information regarding the finance facility during and after the repayment of all credit provided, along with updated personal and financial information.

3. May collect and monitor personal information about you as is necessary for the administration and protection of such credit.

4. May provide any of the personal information to a third party employed by the MMML Finance Partner to assist in enforcement of any agreement between you and them.

5. May request that the MMML Finance Partner, or any related MMML Finance Partner, send you details of other products and services from time to time.

Provision of Additional Services

You authorise the MMML Finance Partner to disclose personal information about you to a credit agency for the purposes of compiling a credit report and creating a credit profile. Further, you authorise the MMML Finance Partner to use your personal information for merchandising, market research, and offering additional services, including newsletters from MMML or the offer of additional credit facilities.

The information that may be disclosed includes: name, address, telephone number, loan amount of any facility, any debits made, frequency and amounts of payments made, including details of overdue payments. You understand that you have the right to access and request correction of your personal information held by the credit reporting agency.

Data Retention

We retain your personal information for the following periods:

Credit application data — at least seven years from the date of application or completion of the credit facility, whichever is later, to comply with regulatory requirements.

AML/CFT records — at least seven years from the end of the business relationship or completion of the relevant transaction, as required under the AML/CFT Act 2009.

Marketing data — until you opt out of marketing communications or request deletion, unless we are required to retain it for legal purposes.

Website analytics data — 26 months in accordance with our analytics provider settings.

Your Rights

Under the Privacy Act 2020, you have the right to:

1. Access the personal information we hold about you;

2. Request correction of any inaccurate or incomplete information;

3. Opt out of marketing communications at any time;

4. Request information about how your data has been used or disclosed;

5. Make a complaint to the Privacy Commissioner if you believe your privacy has been interfered with.

Policy Review

Material changes will be communicated through our website. These Terms and Conditions are governed by New Zealand law, with authority over disputes resting in New Zealand courts.
